This Privacy Policy explains how Whispa, Inc. (“WHISPA™”, “we”, “us”, “our”) collects, uses, discloses, and protects information when you use the WHISPA™ mobile application and related services (the “Service”).

For users in jurisdictions where this concept applies, Whispa, Inc. is the data controller or business responsible for the personal information described in this Privacy Policy.

2. Information We Collect

We collect information in the following categories.

A) Information You Provide

Information you choose to provide when using the Service may include account and profile details such as name, email address, phone number if used, date of birth, photos, profile text, interests, preferences, gender-related information where provided, relationship or discovery preferences, and other information you choose to add to your profile.

You may also provide content through the Service, including messages, likes, matches, reactions, profile content, photos, and other interactions with users. We may collect communications with us, including support requests and feedback. We may also collect message metadata such as timestamps, delivery status, and interaction data. We do not routinely read private messages, but we may access or review content where necessary for moderation, safety, fraud prevention, user reports, legal compliance, or to protect the Service and our users.

B) Sensitive Personal Information

Some information you provide or generate through the Service may be considered sensitive personal information under certain laws. This may include precise location where enabled, photos, verification-related information, dating or relationship preferences, profile information, and other information that may reveal personal characteristics or preferences, if you choose to provide it.

Where required by applicable law, we process sensitive personal information only with your consent, as necessary to provide the Service you request, to protect user safety and platform integrity, or as otherwise permitted by law. You may withdraw consent or manage permissions through the app or your device settings, although some features may not work properly without certain information.

C) Verification Information

To promote authenticity, safety, and trust, WHISPA™ may use selfie verification and liveness checks provided by third-party verification vendors. The third-party provider processes selfie images and liveness signals to return a verification result, such as passed or failed.

WHISPA™ does not store raw liveness videos, biometric identifiers, or biometric templates received from the verification provider, and does not use biometric data to uniquely identify users. We may store limited verification status information and audit logs, such as timestamps, verification outcomes, and fraud-prevention signals, to prevent fake accounts, repeat abuse, and violations of our Terms.

D) Device, Usage, and Location Data

We automatically collect certain technical and usage information, including device type, operating system, app version, language, time zone, IP address, device identifiers, advertising identifiers where available, crash reports, diagnostics, and performance data.

We also collect usage and activity data, such as features used, screens viewed, interactions, likes, matches, profile views, session duration, and app events. If you enable location permissions, we may collect approximate or precise location data depending on your device settings. Location data, where enabled, is used to support discovery features, improve relevance, and help operate the Service. You can disable location access at any time in your device settings.

E) Information from Third Parties

We may receive limited information from third parties, including app stores such as Apple or Google related to downloads, subscriptions, payments, refunds, fraud prevention, and account status. We may also receive information from analytics, attribution, hosting, security, customer support, moderation, and verification service providers that support the operation of the Service.

3. How We Use Information

We use information to provide, operate, maintain, and improve the Service; create and manage accounts; display profiles; enable likes, matches, messages, Magic Sync, recommendations, compatibility features, and other discovery tools; personalize user experience; verify users and promote safety; prevent fraud, spam, fake accounts, abuse, and misuse; moderate content and enforce our Terms; process purchases and subscriptions through Apple or Google; analyze usage and performance; fix bugs and crashes; develop new features; respond to support requests; send service-related notices; send marketing communications where permitted and where you have opted in or where otherwise allowed by law; comply with legal obligations; and protect the rights, safety, and integrity of WHISPA™, our users, and third parties.

Compatibility and discovery features are intended to help users explore potential connections. They are algorithmic and informational only. They do not produce legal, financial, employment, credit, health, or similarly significant effects.

4. Legal Bases for Processing

Where applicable law requires a legal basis for processing personal information, including in the European Economic Area, the United Kingdom, Switzerland, Brazil, and similar jurisdictions, we rely on one or more of the following legal bases.

We process information to perform our contract with you, including creating your account, providing the Service, enabling core app features, processing purchases, and responding to support requests.

We process information based on legitimate interests, including improving the Service, maintaining security, preventing fraud and abuse, enforcing our Terms, conducting analytics, and protecting users, provided that these interests are not overridden by your rights and interests.

We process information based on consent where required, including certain marketing communications, location permissions, verification-related processing where applicable, and other features where consent is requested.

We process information where necessary to comply with legal obligations, respond to lawful requests, maintain records, and protect legal rights.

5. How We Share Information

We may share information with trusted service providers who process data on our behalf, such as hosting and infrastructure providers, analytics and crash reporting services, verification and fraud-prevention vendors, payment and subscription platforms, moderation and safety tools, customer support tools, communications providers, marketing and attribution platforms, and other vendors that help us operate the Service. These providers may use information only to perform services for us and are subject to confidentiality and data protection obligations.

We may disclose information where required by law, regulation, legal process, court order, or governmental request, or where we believe disclosure is necessary to protect the rights, property, or safety of WHISPA™, our users, or others; investigate fraud, security incidents, or violations of our policies; prevent harm; or enforce our Terms.

If WHISPA™ is involved in a merger, acquisition, financing, reorganization, bankruptcy, sale of assets, or similar transaction, information may be transferred as part of that transaction, subject to applicable law. Where required by law, we will provide notice before your information becomes subject to a materially different privacy policy.

We may share aggregated, anonymized, or de-identified information that cannot reasonably be used to identify you.

6. Advertising, Analytics, and Tracking

We may use analytics, attribution, and measurement technologies to understand how users discover and use the Service, measure performance, improve features, and support marketing.

WHISPA™ does not sell personal information for money. We also do not knowingly sell or share personal information of users under 18.

If we use advertising or attribution technologies that may be considered “sharing” personal information, targeted advertising, or cross-context behavioral advertising under applicable privacy laws, we will provide any required notices and choices, including opt-out mechanisms where required by law.

You may be able to limit advertising identifiers or tracking through your device settings, app settings, platform settings, or other controls provided by Apple, Google, or your device.

7. Your Choices and Controls

Depending on your location and applicable law, you may have the right to access, update, correct, or delete personal information; request a copy of your personal information; object to or restrict certain processing; withdraw consent where processing is based on consent; opt out of marketing communications; opt out of sale, sharing, targeted advertising, or certain profiling where applicable; limit the use or disclosure of sensitive personal information where applicable; and appeal certain decisions if required by law.

You can manage certain information directly in the app, including profile details and account settings. You can also manage location access, notifications, camera access, photo access, and advertising identifiers through your device settings.

To submit a privacy request, contact us at tech@whispa.com with the subject line “Privacy Rights Request.” We may need to verify your identity before processing certain requests. We will respond within the timeframe required by applicable law.

8. EEA, UK, and Swiss Privacy Rights

If you are located in the European Economic Area, the United Kingdom, or Switzerland, you may have rights under applicable data protection laws, including the right to access, rectify, erase, restrict, or object to processing of your personal data, the right to data portability, and the right to withdraw consent where processing is based on consent.

You also have the right to lodge a complaint with your local data protection authority. We encourage you to contact us first so we can try to resolve your concern.

9. California and United States Privacy Rights

If you are a California resident or a resident of another U.S. state with applicable privacy rights, you may have the right to know what personal information we collect, use, disclose, sell, or share; request access to personal information; request correction of inaccurate personal information; request deletion of personal information; opt out of sale, sharing, targeted advertising, or certain profiling where applicable; limit the use and disclosure of sensitive personal information where applicable; designate an authorized agent to submit certain privacy requests on your behalf where permitted by law; and not be discriminated against for exercising your privacy rights.

WHISPA™ does not sell personal information for money. If our use of advertising, attribution, or analytics technologies is considered “sharing” or targeted advertising under applicable law, we will provide the required opt-out options.

California residents may designate an authorized agent to submit privacy rights requests on their behalf. We may require proof of authorization and may need to verify your identity before completing the request, unless otherwise prohibited by law.

10. Brazil and Other International Privacy Rights

If you are located in Brazil or another jurisdiction with applicable privacy laws, you may have rights to confirm whether we process your personal information, access your information, correct incomplete or inaccurate information, request anonymization, blocking, or deletion where applicable, request portability where available, withdraw consent, and obtain information about public or private entities with whom we share data.

Users in other countries may also have privacy rights under local laws. We will honor applicable rights requests as required by law.

11. Data Retention

We retain personal information for as long as necessary to provide the Service and for legitimate business purposes such as safety, fraud prevention, dispute resolution, legal compliance, accounting, enforcement of our Terms, and protection of users.

Account data is generally retained while your account is active. When you delete your account, we begin deletion and de-identification processes. Residual copies may remain in backups for a limited period, typically up to 90 days. Security logs, fraud-prevention data, moderation records, and legal records may be retained longer where necessary for safety, compliance, dispute resolution, or enforcement.

Deletion requests are typically processed within a reasonable timeframe, subject to applicable law, security requirements, and operational limitations.

12. Data Security

We use administrative, technical, and physical safeguards designed to protect personal information, including measures intended to reduce unauthorized access, misuse, loss, alteration, disclosure, and destruction. However, no system is completely secure, and we cannot guarantee absolute security of information. If you believe your account has been compromised, please contact us immediately at tech@whispa.com.

13. International Data Transfers

We are based in the United States, and we may process, store, and transfer information in the United States and other countries where we or our service providers operate. These countries may have data protection laws that differ from those in your jurisdiction.

Where required by applicable law, we rely on appropriate safeguards for international data transfers, such as contractual protections, standard contractual clauses, adequacy decisions, or other lawful transfer mechanisms.

14. Age Restriction

The Service is intended only for users 18 years of age or older. WHISPA™ does not knowingly collect personal information from individuals under 18. If we become aware that a user is under 18, we will take steps to remove the account and associated data. 15. User Content and Public Visibility

Some information you provide may be visible to other users, such as your profile photos, profile text, interests, preferences, and other content you choose to make available through the Service. Please be careful when sharing information with other users. WHISPA™ is not responsible for information that you choose to share publicly or directly with other users.

16. Third-Party Links and Services

The Service may contain links to third-party websites, services, or features that are not operated by WHISPA™. We are not responsible for the privacy practices of third parties and encourage you to review their privacy policies. This Privacy Policy applies only to information collected through the WHISPA™ Service.

17. Changes to This Policy

We may update this Privacy Policy from time to time to reflect changes in our practices, technology, legal requirements, or other factors. The updated version will be posted within the Service or on our website with a revised “Last Updated” date. If changes are material, we may provide additional notice, such as an in-app notification or email, where required by applicable law.
