Effective Date: November 28, 2025
Last Updated: January 31, 2026
This Privacy Policy explains how Whispa, Inc. (“WHISPA™”, “we”, “us”, “our”) collects, uses, discloses, and protects information when you use our mobile application and related services (the “Service”).
1. Who We Are
Whispa, Inc., 9171 Wilshire Blvd, Suite 500/9042, Beverly Hills, CA 90210, United States.
Email: tech@whispa.com
2. Information We Collect
We collect information in the following categories.
A) Information You Provide
Information you choose to provide when using the Service includes account and profile details such as name, email, phone number if used, date of birth, photos, profile text, interests, and preferences; content you create or share through the Service, including messages and interactions with other users; and communications with us, including support requests. We may also collect message metadata such as timestamps, but we do not read private messages except as necessary for moderation, safety, or legal compliance.
B) Verification Information
To promote authenticity, safety, and trust, WHISPA may use selfie verification and liveness checks provided by third-party verification vendors. The third-party provider processes selfie images and liveness signals solely to return a verification result (for example, passed or failed). WHISPA does not store raw liveness videos, biometric identifiers, or biometric templates, and does not use biometric data to uniquely identify users. We may store limited verification status information and audit logs, such as timestamps and verification outcomes, to prevent fraud, repeat abuse, and violations of our Terms.
C) Device, Usage, and Location Data
We automatically collect certain technical and usage information, including device type, operating system, app version, language, time zone, IP address, and device identifiers such as advertising identifiers where available; usage and activity data such as features used, screens viewed, interactions, and session duration; and crash reports, diagnostics, and performance data. If you enable location permissions, we may collect approximate or precise location data based on your device settings. Location data, where enabled, is used to support discovery features and improve relevance of the Service. You can disable location access at any time in your device settings.
D) Information from Third Parties
We may receive limited information from third parties, including app stores such as Apple or Google related to downloads, subscriptions, or fraud prevention, as well as analytics, attribution, hosting, security, and verification service providers that support the operation of the Service.
3. How We Use Information
We use information to provide, operate, and maintain the Service; personalize user experience and enable compatibility and discovery features such as recommendations and Magic Sync; verify users and protect the community, including fraud prevention, moderation, and enforcement of our Terms; analyze usage, improve performance, develop new features, and fix bugs or crashes; communicate with you about updates, security notices, and support requests; send marketing communications where permitted and where you have opted in, with the ability to opt out; and comply with legal obligations and protect the rights, safety, and integrity of WHISPA and its users. Compatibility and discovery features are intended to assist users in exploring connections and do not produce legal or similarly significant effects.
4. How We Share Information
We may share information with trusted service providers who process data on our behalf, such as hosting and infrastructure providers, analytics and crash reporting services, verification and fraud-prevention vendors, and customer support tools. These providers may use information only to perform services for us and are subject to confidentiality obligations. We may also disclose information where required by law, regulation, or legal process, or where we believe disclosure is necessary to protect the rights, property, or safety of WHISPA, our users, or others, or to investigate fraud, security incidents, or violations of our policies. If WHISPA is involved in a merger, acquisition, financing, reorganization, bankruptcy, or sale of assets, information may be transferred as part of that transaction, subject to applicable law.
5. Your Choices and Controls
Depending on your location and applicable law, you may access, update, or correct your profile information within the app; request deletion of your account and personal data; withdraw consent where processing is based on consent, such as marketing communications; and opt out of marketing emails or notifications using unsubscribe links or app settings. You can also manage permissions for location access, notifications, and advertising identifiers through your device settings.
6. Data Retention
We retain personal information for as long as necessary to provide the Service and for legitimate business purposes such as safety, dispute resolution, fraud prevention, and legal compliance. Account data is generally retained while your account is active. When you delete your account, we begin deletion and de-identification processes. Residual copies may remain in backups for a limited period, typically up to 90 days. Security logs and fraud-prevention data may be retained longer where required for safety and legal obligations. Deletion requests are typically processed within a reasonable timeframe, subject to applicable law and security requirements.
7. Data Security
We use administrative, technical, and physical safeguards designed to protect personal information. However, no system is completely secure, and we cannot guarantee absolute security of information.
8. International Data Transfers
We may process and store information in the United States and other countries where we or our service providers operate. These locations may have different data protection laws than your jurisdiction. Where required, we rely on appropriate safeguards for international data transfers.
9. Age Restriction
The Service is intended for users 18 years of age or older. WHISPA does not knowingly collect personal information from individuals under 18. If we become aware that a user is under 18, we will take steps to remove the account and associated data.
10. No Sale of Personal Information
WHISPA™ does not sell personal information.
11. Changes to This Policy
We may update this Privacy Policy from time to time. The updated version will be posted with a revised “Last Updated” date. If changes are material, we may provide additional notice through the Service.
