These Terms of Use ("Terms") govern your use of the WHISPA mobile application ("App") and services provided by WHISPA LLC ("we", "us", "our"). By creating an account or using WHISPA, you agree to these Terms.
If you do not agree, please do not use WHISPA.
1. Eligibility
You must be at least 18 years old to use WHISPA. By using the App, you represent and warrant that you meet this age requirement.
2. License to Use
WHISPA grants you a limited, non-exclusive, revocable license to use the App for personal and non-commercial purposes, subject to these Terms.
3. Account and Security
You are responsible for your account and all activities under it. Keep your login credentials secure. Notify us of any unauthorized use.
4. Verification Process
To enhance user safety, we may require a facial liveness and selfie check using a third-party provider. WHISPA does not store government-issued IDs or biometric data.
5. User Responsibilities
You agree not to use WHISPA for unlawful or harmful conduct. You agree to treat others respectfully and not to harass, defraud, or impersonate any person.
6. Paid Features
Certain WHISPA features are available for purchase. These may be one-time or subscription-based and are processed via Apple or Google. All payments are final and non-refundable.
7. Match Recommendations and Algorithms
WHISPA uses proprietary algorithms that consider astrological compatibility, psychological profiles, and user preferences to suggest potential matches. These algorithms aim to enhance your discovery experience, but WHISPA does not guarantee the accuracy, compatibility, or success of any match. A 99% compatibility rating is algorithmic and does not represent real-life or scientific certainty.
8. User Content
You are solely responsible for the content you upload. By submitting content, you grant WHISPA a non-exclusive, worldwide, royalty-free license to use, display, and distribute it for app functionality.
9. Intellectual Property
WHISPA and its trademarks, logos, and designs are owned by WHISPA LLC. All rights are reserved.
10. Disclaimers and Limitation of Liability
WHISPA provides the app "as is" and "as available". We do not guarantee uninterrupted service or the success of any interaction. We are not responsible for the behavior of other users or third parties.
11. Termination
We reserve the right to suspend or terminate your account at any time for violation of these Terms or misuse of the platform.
12. Governing Law
These Terms are governed by the laws of the State of Wyoming, USA.
13. Entire Agreement and Severability
These Terms constitute the entire agreement between you and WHISPA. If any provision is deemed invalid, the rest shall remain enforceable.
